Carl Shusterman: Yes.
S.2045 would go in effect immediately upon being signed by the President. However, should
Representative Smith's Bill pass, the new cap would not go into effect until the Labor
Department issues the long-awaited regulations under the 1998 Bill which raised the H-1B
cap to 115,000.
